I emailed them at tips@, ben@, and marco@consumerist.com, bringing the issue to their attention, and stating that they either owed me one meelion dollars, or an attribution link. They opted for the latter. :-)

I also often wonder how far the non-commercial part stretches. When the site in question is a splog of some sort, or a blatant placeholder for advertising, I'd say the use is clearly commercial.

However... I do sometimes (try reaching a page of my site through google, by clicking on a link) display ads on my site. Does that mean that I cannot display on my blog a photo which is NC?

I haven't figured this one out yet.

<!--%kramer-pre%-->headlines, and all that snaz, but what was his response. Being a model blogger for bigger-than-thou companies why don’t you respond and admit your wrong and do the right thing? http://www.stockphototalk.com/phototalk/2007/02/consumerists_ed.html http://www.tinyscreenfuls.com/2007/01/consumerist-stole-one-of-my-creative-commons-licensed-images/ I find the Flickr Pool, just a mild form of damage control. I want to read the apology to photo artists stright from the mouth of Ben. That, my friend, would indeed be the right thing to do. <!--%kramer-post%-->

<!--%kramer-pre%-->seen some semi-breaking news as a result. What's the value? Well, for example, I can tell you that right now Robert Scoble and Marc Orchant are on their way to DEMO. I can also tell you that the Consumerist lifted one of Josh Bancroft's photos; yes, he blogged it, but he Twitter'd it first. Sadly, I saw that Colin Walker's home was burglarized in the UK this morning (bummer mate!). On the plus side, Scott McNulty received over 70 pairs of socks from Amazon. OK, that's more of the entertaining part but, you get<!--%kramer-post%-->
